DATA PROTECTION AND PRIVACY POLICY














Within the scope of its commercial activity, TALARC SARL (hereinafter TALARC) is led to gather and process personal data of its users (hereinafter referred to as the "users").

The purpose of this privacy policy, implemented by TALARC, is to provide the users with summary and overall information on the processing of personal data operated by TALARC.

TALARC attaches particular importance to the respect of privacy of the users and of the confidentiality of their personal data, is committed to thus process the data in compliance with the applicable laws and regulations, and specially law no. 78-17 of 6 January 1978 relating to data processing, files and liberties (hereinafter the "data processing and liberty act"), and Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 relating to the protection of physical persons in respect of the processing of personal data and relating to the free circulation of these data (hereinafter referred to as "GDPR").

Definitions

Personal data: constitutes data of a personal nature, any information relating to an identified or identifiable physical person, i.e. who can be identified, directly or indirectly, with reference to an identification number or to one or several elements that are unique to him.

Processing of personal data: constitutes the processing of personal data, any operation or any whole of operations concerning such data, no matter what process is used, and especially the gathering, registration, organisation, preservation, adaptation or modification, extraction, consultation, use, communication through transmission, dissemination or any other form of provision, reconciliation or interconnection, as well as the locking, deletion or destruction.

Cookie: a cookie is information filed on the hard drive of a web user by the server of the site that he visits. It contains several data: the name of the server that files it, an identifier in the form of a unique number, and possibly an expiration date. This information is sometimes stored on the computer in a simple text file that a server has access to to read and register the information.

Collected data

TALARC collects the data of the users in order to provide them with services to which they subscribed on the platform.

The obligatory or optional nature of the data collected (to be able to finalise the registration of the user and provide him with the TALARC offers and services) is indicated with an asterisk during the collection process.

In addition, certain data are collected upon collection of the consent of the user as a result of the actions of the user on the site (see the paragraph relating to cookies).

Purposes

The personal data collected by TALARC when services are provided, are necessary in order to execute the contracts concluded with the user, or to allow TALARC to pursue its legitimate interest while respecting the rights of the user. The entirety of these personal data are processed on the basis of gathering the consent of the user.

The purposes for which TALARC processes the data are as follows:

  • The commercial and account management of the contract;
  • The marketing activation and animation management;
  • The detection of malicious behaviour (fraud, phishing, spam, etc.);
  • The improvement of the path of the site user;
  • More broadly, any purpose referred to in article 2 of Deliberation no. 2012-209 of 21 June 2012 concerning the creation of a simplified norm regarding the automated processing of personal data relating to the management of users and prospects.

Recipients of data

The personal data collected are intended for the commercial and accounting departments of TALARC. The data can be transmitted to the branches of TALARC, or to subcontracting companies which TALARC can use within the scope of executing its services.

In doing so, the personal data can be subject to a transfer to another member state or not of the European Union. The user will be systematically warned and his consent will be explicitly gathered, TALARC implements guarantees that ensure the protection and security of these data in accordance with the regulations.

TALARC does neither transfer, nor rent out the personal data to third parties for marketing purposes.

However, the disclosure of personal data to third parties can intervene in the following cases:

  • Upon authorisation on their part;
  • Upon request of the legally competent authorities, upon request of the judicial authority, or within the scope of judicial litigation.

Length of data retention

To satisfy its legal obligations or in order to have the information necessary to assert its rights, TALARC can archive the data under the conditions intended by the regulations.

In that respect, the personal data collected by TALARC relating to the identity and contact details of its users are archived for a maximum period of ten years after the contractual relations have ended for the client users, or starting from their collection by the data controller or from the last contact originating from the prospective user for the data relating to the latter.

The cessation of contractual relations is understood as being the express termination of the contract by the user.

Right of the users

In accordance with the regulations, the user benefits from the rights of access and rectification of personal data that concern him, that allow him to rectify, complete, update or delete the data that are incorrect, incomplete, ambiguous, outdated or the collection, use, communication or preservation of which is prohibited.

The user also benefits from rights to request the limitation of data processing, and to counteract for legitimate reasons the processing of these personal data. Additionally, the user can communicate instructions on the type of personal data in case of death.

When this is applicable, the user can request the portability of his data or, when the processing has a consent as legal basis, can withdraw his consent at any time.

The user can exercise his rights by sending an e-mail to support@goliath-store.com.  

The user can also at any moment personally modify the data that concern him by logging into https://www.goliath-store.com and by clicking on "my account" or by contacting customer service at the address support@goliath-store.com.

The user can unsubscribe from the Goliath-store newsletter or marketing e-mails by following unsubscribe links listed on each of these e-mails.

The can, in case of a dispute, lodge a claim with the CNIL, the contact details of which are listed on the website http://www.cnil.fr.

The user can access detailed information on the use of these personal data, especially regarding the purposes of data processing, the legal bases that allow TALARC to process the data, their retention periods, their recipients and, if applicable, the transfers of these to a country that is not a member of the European Union, as well as the implemented safeguards. The site of TALARC uses cookies that have the purpose of facilitating the navigation on the site, to execute the service provided by TALARC, to measure the audience of the site and performances of advertising media or also to allow for pages of the site to be shared.

Lifetime of cookies

The cookies are filed in the terminal of the user for a maximum duration of 13 months starting from the expression of consent of the user.

After this time, the consent will be obtained again.

Security

TALARC has taken all useful precautions to preserve the security of personal data and, especially, to prevent that these are distorted or damaged or that unauthorised third parties have access to it.

These measures are especially the following:

  • Multilevel firewall,
  • Anti-virus of proven recognition and detection of intrusion attempts,
  • Encrypted transmission of data using SSL/https/VPN technology,

In addition, access to data processing by the departments of TALARC to recipients requires an authentication of people who access the data, using an individual access code and password that are sufficiently tested and renewed regularly.

The data passing over unsecured communication channels are subject to technical measures aimed at rendering these data incomprehensible for any unauthorised person.

TALARC reserves itself the right to develop this confidentiality policy in order to be in conformity with the modifications of laws and regulations in effect.
